Court of Appeal’s Tentative Return to In-Person Hearings

The Ontario Court of Appeal is considering a return to in-person hearings as early as November 8, 2021. The Court of Appeal has released a document called “Tentative Model for Return to In-Person Proceedings“.

There may be a staggered return, with in-person criminal appeals beginning before civil appeals.

There will be a number of health and safety protocols, including wearing masks except when making submissions, screening, and physical distancing.

Attendance will be limited to counsel and self-represented litigants. Others may observe by Zoom.

There will still be the option for appeals to be heard by Zoom, and counsel do not need to give a reason for requesting this.

Counsel will be encouraged to robe.
