SABS Bad Faith Decision Good For Insurers

Kevin Adams was recently quoted in a Law Times article called “Court of Appeal affirms supremacy of Licence Appeal Tribunal”.

The article addresses the Court of Appeal’s decision inĀ Stegenga v. Economical Mutual Insurance Company, 2019 ONCA 615. The Court of Appeal held that statutory accident benefits claimants cannot sue in court for bad faith.

Kevin says that “this decision eliminates a risk for insurers, who now only have to worry about a 50-per-cent special award, which is quantifiable and much lower than the potential risk for a bad faith claim”.
